Terms and Conditions of Purchase in the Online Shopping Environment at www.goldeneaglepetfoods.ee

1. General Terms and Conditions
1.1. The Terms and Conditions apply to legal relationships that arise between the customer (hereinafter the Customer) and OÜ Katralex (hereinafter the Seller), the owner of the online shopping environment (hereinafter the E-store) at www.goldeneaglepetfoods.ee in connection with purchasing products in the E-store. In addition to these Terms and Conditions, the legal relationships arising from purchasing products in the E-store are regulated by the legislation effective in the Republic of Estonia. 
1.2. The Seller information: company: Katralex OÜ, reg. no. 14948346, located at Käopoja 14, Tallinn, 11311.
1.3 Katralex OÜ is entitled to amend and complete these Terms and Conditions as well as the Price List due to the development of the E-store and to ensure the better and safer use of the E-store. Changes and supplements to the Terms and Conditions and the Price List will be announced through www.goldeneaglepetfoods.ee. Amendments and supplements to the Terms and Conditions and the Price List shall take effect when they are made public on www.goldeneaglepetfooods.ee . If the buyer has placed their order before the changes took effect, the Terms and Conditions valid at the time of making the order shall apply to the legal relationship between you and the E-store, unless otherwise provided by law or these Terms.

2. Prices
2.1. All prices in the E-store are indicated next to the products in Euros and include VAT. A fee for delivery of the products will be added to the price.
2.2. The E-store reserves the right to adjust prices. If the Customer made his/her order before the price changed, the price shown on the invoice at the time of placing the order applies to the Customer.
2.3. The delivery fee depends on the method of delivery, the size and weight of the goods. The delivery fee is shown to the buyer when placing an order.

3. Products
3.1. Information about the products is presented in the E-store directly next to the products.
3.2. If the Customer places an order, but it turns out that the given product is out of stock, it is not possible to fulfil the order by the E-store. In that case, an employee of the E-store will contact the Customer and offer a replacement, a possible new delivery time, or a refund within 14 days at the latest.

4. Making a purchase
4.1. The moment the Customer clicks the “Order the product” button, a shopping cart is formed.
4.2. The quantity of products in the shopping cart can be changed by either adding or removing products. To change the quantity, the Customer must click the “Change / Remove” button, as required. Next, they select the delivery method and fill in the contact information field, then they click the “Place the order” button, after which the order confirmation will be sent to the Customer’s e-mail.

5. Paying for products
5.1 The Customer shall pay for the product on the basis of their order. After receiving the payment, the invoice will be sent to the Customer’s e-mail address. 
5.2. When placing their order, the Customer undertakes to provide the true data necessary for fulfilling the order.
5.4. The Seller is not responsible for the impossibility of fulfilling the order due to incorrect data provided by the Customer while placing their order, or for any consequences arising therefrom.
5.5. If the ordered products cannot be delivered because they are out of stock, or for any other reason, the Customer shall be notified as soon as possible and the money paid (incl. delivery costs) will be refunded immediately, but not later than within 14 days of receiving the notice. If desired, instead of refund the Customer can choose a similar replacement product for the same price, or agree to a longer delivery time.

6. Delivery and handover of products
6.1. The Customer can choose between different delivery methods. The ways to receive the goods are as follows:
a) Itella Smartpost parcel terminal;
b) Omniva parcel terminal;
c) pick the goods up at Räägu 9, Tallinn (call in advance +372 5565 3505);
d) courier service.
6.2. The Customer should check the correctness of the contact information provided when ordering to avoid delays and misunderstandings in delivery. The E-store and the courier company are not responsible for delays in delivery and misunderstandings if the delay or misunderstanding is due to the inaccuracy or incorrectness of the information provided by the Customer when placing their order.
6.3. If the Customer has placed their order on a weekend (in the period after 15.00 on Friday until 09.00 on Monday) or on a public holiday, the term of 2-4 working days will start at 09.00 on the first working day following the weekend or public holiday.
6.4. If the product does not reach the Customer in good condition and in a sealed package, the Customer is obliged to notify the E-store by sending a letter to info@goldeneaglepetfoods.ee .

7. Right of withdrawal
7.1. The Customer has the right to return the goods purchased in the E-store, ie to withdraw from the contract concluded via the web environment, by sending an e-mail to info@goldeneaglepetfoods.ee no later than within 14 days after receiving the goods. The e-mail must, among other things, indicate the number of the order for the goods to be exchanged or returned, and a claim stating whether an exchange or a refund is requested. Upon returning the goods, the Customer shall bear the costs of returning, which is a maximum of 10 euros + 5% of the cost of the purchased goods, except in cases where the delivered product does not comply with the order. The goods must be returned to the official address of Katralex OÜ or to the courier previously agreed and sent by the company. 
7.2. When returning the goods purchased with a special order (products marked in the E-store as “Delivery within 1-2 weeks”), the buyer must pay for transporting the special order, which is 48 euros.
7.3. The goods returned to the E-store by the Customer must be unused (the package must be unopened).
7.4. If the goods ordered by the Customer do not correspond to what was delivered or displayed in the E-store, they shall be exchanged for the correct product, or the Customer shall be allowed to exchange the ordered product for a new equivalent replacement.
7.5. In case of returning a non-compliant product, the amount paid for the product (including transport costs) shall be transferred to the bank account given by the Costumer no later than within 14 days of receiving notice of withdrawal and request to return the product.
7.6. The right of withdrawal does not apply when the Customer is a legal person.
7.7. The product can be exchanged or returned via a parcel machine or a courier. 
7.8. If the delivery method was Itella Smartpost or Omniva parcel machine, the product can be exchanged or returned via Itella Smartpost or Omniva parcel machine. 
7.9. If the courier service was chosen as the delivery method, the product can also be exchanged or returned via a parcel machine.
7.10. The Seller has the right to ask the Customer up to 10 Euros for transport of the returned product, and deduct the sum from the refund.
7.11. The Seller shall transfer a refund to the Customer within 14 days after the well-timed arrival of the product in the E-store. The refund shall be transferred to the same bank account from which the Customer made the payment for the order. 
7.12. The E-store may refuse to make refunds until the product which is the subject of the contract has been returned, or until the Customer has provided evidence that (s)he has returned the product, whichever occurs first.
7.13. If the Customer has clearly chosen a delivery method different from the cheapest common delivery method offered by the E-store, the E-store is not required to compensate the cost exceeding the common delivery cost.
7.14. In case of a refund, the Seller will not reimburse the Customer for the cost of the courier service for the respective purchase.
7.15. The product to be exchanged or returned must not be opened or in damaged packaging, the product must be in the original packaging and all original labels must be affixed to the product.
7.16. The E-store has the right to withdraw from the sale transaction and demand that the goods be returned by the buyer if the price of the goods in the E-store was marked as significantly lower than the market price by mistake.

8. Filing complaints
8.1. The E-store is responsible for the non-compliance of the goods with the Terms and Conditions of the contract, and for deficiencies, which already existed at the time of delivery of the goods. The Customer has the right to contact the E-store within two months at the latest by sending an e-mail to info@goldeneaglepetfoods.ee
8.2. The E-store is not responsible for defects occurring after the delivery of the goods to the buyer. If the goods purchased from the E-store have defects for which the E-shop is responsible, the E-store shall repair or replace the defective goods. If the goods cannot be repaired or replaced, the E-store shall return to the buyer all of the payments involved in the contract of sale. The E-store shall respond to the Customer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
8.3. The Seller shall not be liable for damages caused by abnormal use of the ordered products, as well as for delays in delivery, if this was caused by circumstances beyond the Seller’s control and/or by reason of force majeure.

9. Liability
9.1. The Seller and the Customer shall be liable to each other for the damage caused to the other party by breach of these Terms and Conditions, in the cases and to the extent provided by law effective in the Republic of Estonia.
9.2. The Seller shall be liable for the product to the extent of the sales price.
9.3. The Customer undertakes to use the E-store only for purposes consistent with law and good practice. 

10. Privacy and data security
Katralex OÜ does not transfer the Customer’s personal data to third parties, except for the information necessary for transport services.
The Customer has the right to request the deletion of his/her data from the database of www.goldeneaglepetfoods.ee .
Katralex OÜ is eager to resolve all issues and misunderstandings with its Customers.

The Customer has the right to turn to the Consumer Protection and Technical Regulatory Authority to protect their interests.

11. Dispute resolution
Disputes arising between the Customer and the Seller related to ordering and purchasing products in the E-store shall be resolved through negotiations. If no agreement is reached, the Customer has the right to turn to the Consumer Protection and Technical Regulatory Authority to protect their rights. Disputes shall be resolved in accordance with the legislation effective in the Republic of Estonia. The questions unanswered in these Terms and Conditions will be resolved according to legal acts in force in the Republic of Estonia.
